The basic common-law principle is that an individual cannot pass better title than he/she has and a buyer can acquire no better title than that of the seller. Encumbrance Certificate is issued form the sub-registrar’s office where the deed has been registered. Certificate clarifies whether there is any legal due or complaint regarding property.
